Spain's government has approved a bill that imposes significant fines on companies for failing to label content generated by artificial intelligence (AI). The legislation, spearheaded by Digital Transformation Minister Oscar Lopez, aims to curb the misuse of AI, particularly the spread of deepfakes, by requiring clear identification of AI-generated content. The bill, which aligns with the European Union's AI Act, classifies non-compliance with proper labeling as a serious offense. Fines can reach up to 35 million euros or 7% of a company's global annual turnover, whichever is higher. This measure reflects Spain's commitment to implementing the EU's comprehensive regulatory framework for AI. The newly-created AI supervisory agency AESIA will oversee enforcement of these rules. In addition to labeling requirements, the bill prohibits the use of subliminal techniques, such as chatbots inciting gambling among people with addictions, to manipulate vulnerable groups. It also bans the classification of individuals based on biometric data using AI. However, real-time biometric surveillance in public spaces for national security reasons remains permissible.
