Twenty States Sue Trump Administration Over Medicaid Data Sharing With ICE

A coalition of 20 states filed suit in the U.S. District Court for the Northern District of California on Tuesday, seeking to block the Trump administration from giving Medicaid beneficiaries’ personal health data to the Department of Homeland Security for immigration enforcement.

The complaint alleges the Department of Health and Human Services last month transferred files containing millions of records to Homeland Security in violation of the Medicaid Act, which limits disclosures to purposes that benefit public health or protect program integrity. The attorneys general say the move jeopardizes the privacy of roughly 78.4 million people enrolled in Medicaid and the Children’s Health Insurance Program and could deter immigrants from seeking medical care.

California Attorney General Rob Bonta, who leads the coalition alongside counterparts in Washington, Colorado, New York and other states, accused President Donald Trump, HHS Secretary Robert F. Kennedy Jr. and DHS Secretary Kristi Noem of “weaponizing Medicaid” for mass surveillance. Washington Attorney General Nick Brown added that residents expect their confidential health information to be used solely for care, not immigration investigations.

Federal officials contend the data access is aimed at preventing fraud and ensuring benefits go only to those legally entitled to them. The states are asking the court for an injunction halting any further transfers and barring DHS or Immigration and Customs Enforcement from using records already obtained.
