Judge Clears Way for Deportation of Boulder Attack Suspect’s Family

A federal judge in San Antonio on Wednesday dismissed a habeas corpus and injunctive-relief petition filed by the wife and five children of Mohamed Sabry Soliman, the suspect in the 1 June Molotov-cocktail attack that killed one person and injured several others at a rally for Israeli hostages in Boulder, Colorado. The ruling by U.S. District Judge Orlando Garcia dissolves a temporary restraining order that had halted the family’s removal and allows U.S. Immigration and Customs Enforcement to continue ordinary deportation proceedings against the six Egyptian nationals.
Garcia found the court lacked jurisdiction to block the proceedings because the Immigration and Nationality Act bars judicial review of discretionary detention and removal decisions before a final order is issued. He also said earlier White House social-media posts asserting that the family’s deportation was being “expedited” were inaccurate and had created confusion that justified the original restraining order.
Soliman, 34, is being held on state charges that include first-degree murder, attempted murder and assault, as well as a federal hate-crime count. Prosecutors allege he threw multiple firebombs at demonstrators while shouting “Free Palestine.” An 82-year-old woman injured in the attack died this week, bringing the death toll to one. A preliminary hearing in the state case is scheduled for 15 July.
