Boston Judge Defies Supreme Court, Keeps Ban on South Sudan Deportations

U.S. District Judge Brian Murphy said late Monday that his injunction blocking the deportation of certain non-citizens to South Sudan and other third-party countries "remains in full force and effect," notwithstanding a 6–3 Supreme Court ruling earlier in the day that cleared the Trump administration to resume the removals.

Murphy, a Boston-based judge appointed by President Joe Biden, originally barred the expulsions in May on due-process grounds, ordering the government to keep the detainees in custody and provide interpreters and counsel. Government filings state that eight of the detainees—described by officials as violent criminals—are currently being held by U.S. personnel in Djibouti while the legal battle unfolds.

The Supreme Court majority granted the administration’s emergency request to pause Murphy’s preliminary injunction, but the judge said the high court did not address his separate remedial order and therefore it still governs the case. He cited Justice Sonia Sotomayor’s dissent, which argued that the district court’s remedial directives were not properly before the justices.

White House adviser Stephen Miller told Fox News on Monday night that the administration would "hold this judge accountable," adding that observers should "expect fireworks" on Tuesday. The Justice Department has not yet detailed what steps it might take. Representatives for the Department of Homeland Security and the court declined to comment.
