President Donald Trump said on Tuesday that he has directed Homeland Security Secretary Kristi Noem to examine whether former Homeland Security Secretary Alejandro Mayorkas should face criminal investigation for his management of the U.S.-Mexico border under the Biden administration.
Speaking at a press conference in Ochopee, Florida, after touring a newly opened migrant detention facility nicknamed “Alligator Alcatraz,” Trump was asked by Blaze reporter Julio Rosas why Mayorkas had not been arrested. The president replied, “Was he given a pardon? … If he wasn’t given a pardon, I could see looking at that,” and told Noem to “take a look” at the matter.
Mayorkas, who served as DHS chief from 2021 to 2025, was impeached by the Republican-controlled House last year for what lawmakers called a “willful and systemic refusal” to enforce immigration laws, but the Democratic-led Senate did not act on the charges. No federal criminal case has been filed against him, and President Joe Biden did not issue a pardon before leaving office.
Trump’s remarks reflect mounting pressure from conservative lawmakers and activists for legal action against officials they blame for record levels of illegal border crossings during the previous administration. Neither the White House nor Mayorkas has responded publicly to Trump’s comments.
