Supreme Court Lets Trump Resume Third-Country Deportations, Clears South Sudan Flight

The U.S. Supreme Court, dividing 6–3 along ideological lines, on 23 June lifted a lower-court injunction that had halted the Trump administration’s practice of deporting migrants to so-called third countries where they have no prior ties. The stay nullified U.S. District Judge Brian Murphy’s April order requiring immigration authorities to give affected people ten days’ notice and a chance to raise fears of torture or persecution before removal.

In an unsigned opinion the majority said the administration could resume the policy while litigation proceeds, siding with Justice Department arguments that the injunction hampered diplomatic talks and the expulsion of convicted criminals whose home countries refuse to accept them. Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson dissented, warning the ruling exposes migrants to potential danger without due process.

On 3 July the Court, this time 7–2, clarified that its earlier stay also covers Murphy’s separate order blocking the deportation of eight men being held at a U.S. military facility in Djibouti. The ruling clears immigration officials to send the group—who come from several nations and were convicted of serious crimes—to South Sudan as early as this week. Sotomayor and Jackson again dissented; Kagan concurred with the majority, citing the Court’s prior stay.

The pair of decisions strengthens a central element of President Donald Trump’s stepped-up immigration crackdown, allowing rapid deportations even when destination countries are politically unstable and unrelated to the migrants. Advocacy groups say the fight over the constitutionality of third-country removals will continue in the First Circuit, but for now the administration can proceed without providing advance notice or hearings.
