Supreme Court Clears Trump to Deport Eight Migrants to South Sudan

The US Supreme Court on Thursday cleared the Trump administration to deport eight non-citizens to South Sudan, overruling a federal judge who had blocked the removals and accused officials of ignoring his injunction. In an unsigned order, the justices said their 23 June decision that stayed the judge’s nationwide limits on so-called “third-country” deportations also nullifies his separate ruling covering the eight men, who have been held for six weeks at a US military facility in Djibouti.

The latest action—supported by at least seven members of the Court, with Justices Sonia Sotomayor and Ketanji Brown Jackson dissenting—allows Immigration and Customs Enforcement to complete the flight initially diverted in May. The Department of Homeland Security said the men, all convicted of violent crimes in the United States and from countries including Vietnam, Cuba and Mexico, “will be in South Sudan” by Friday after the country provided diplomatic assurances against torture.

Thursday’s order builds on the Court’s 6–3 ruling of 23 June that lifted Judge Brian Murphy’s requirement that migrants receive 10 days’ notice and a chance to raise fear-of-torture claims before being sent to nations with which they have no ties. That earlier stay re-enabled the administration’s broader policy of rapid “third-country” removals while appeals proceed.

In her dissent, Justice Sotomayor called the majority’s approach a reward for the government’s “flagrantly unlawful conduct” that could expose people to grave danger. The administration argues the policy is needed because some home countries refuse to accept deportees and says the Court’s intervention affirms presidential authority over immigration enforcement.
