The memo states the regime "probably does not have a policy of cooperating with TDA," undercutting a key justification the administration cited when invoking the 1798 Alien Enemies Act to expedite removals. Federal judges in New York and Colorado quickly referenced the intelligence findings in granting preliminary injunctions that bar the government from using the Alien Enemies Act to summarily deport alleged gang members. One judge ordered officials to arrange the return of a 20-year-old Venezuelan man who had been deported to an El Salvador prison in violation of a prior settlement, ruling there is no evidence of an “invasion” required by the statute. Taken together, the appellate decision and the declassified memo leave large portions of the president’s immigration crackdown in limbo, safeguarding humanitarian parole for hundreds of thousands of migrants and raising significant legal hurdles for further use of wartime powers to expel non-citizens.
