U.S. District Judge Randolph D. Moss on Wednesday blocked President Donald Trump’s executive proclamation that barred migrants crossing the U.S.–Mexico border from seeking asylum, ruling that the president exceeded his statutory and constitutional authority.
In a 128-page opinion, the Washington, D.C., judge said neither the Immigration and Nationality Act nor the Constitution allows the White House to create an “extra-statutory, extra-regulatory regime” that suspends asylum or other humanitarian protections. The decision grants class-wide relief to migrants represented by the American Civil Liberties Union and three immigrant-rights organizations.
Moss stayed his injunction for 14 days, giving the administration until July 16 to seek emergency relief from a higher court. He noted that the class certification brings the case within the limits on nationwide injunctions set by the Supreme Court in last week’s Trump v. CASA ruling.
The White House and Department of Homeland Security did not immediately comment, but an appeal is expected. The setback comes as the administration points to sharply reduced illegal crossings—Border Patrol made about 6,070 arrests in June—as evidence that its broader border crackdown is working.
