The Brazilian federal government, represented by the Advocacia-Geral da União (AGU) and supported by President Luiz Inácio Lula da Silva, has filed a petition with the Supreme Federal Court (STF) seeking the suspension of ongoing judicial proceedings related to fraudulent deductions from the benefits of INSS (National Institute of Social Security) retirees and pensioners. The government aims to handle the reimbursement of affected beneficiaries administratively rather than through the courts. To facilitate this, the AGU has requested authorization from the STF to open an extraordinary budget credit to cover these repayments. The total impact of lawsuits against the Union concerning these fraud cases has reached approximately R$1 billion and is expected to grow. More than 3 million beneficiaries have contested illegal deductions, with potential repayments exceeding R$2 billion. Additionally, the government has asked that the reimbursements be excluded from fiscal rules, seeking financial flexibility to address the issue. The president of the INSS has stated that the STF action is intended to provide security for the reimbursement process. The federal administration emphasizes recovering funds for victims without judicialization, aiming to suspend all current cases against the Union and the INSS related to these fraudulent discounts.
