Republican members of the Senate Judiciary Committee opened a hearing on 18 June to examine whether White House staff relied on an autopen to sign legally binding documents during Joe Biden’s 2021-25 presidency, potentially sidelining the president’s direct approval. Theo Wold, a visiting fellow at the Heritage Foundation, testified that Oversight Project researchers traced the first autopen use to the fifth day of Biden’s term and identified three distinct versions of the president’s signature. Wold said the device affixed Biden’s name to more than half of his clemency warrants—32 of 51—and to executive orders and proclamations, including some issued while Biden was in Washington. Republican senators argued that extensive autopen use could call into question the validity of pardons, policy directives and other actions. Most Democratic committee members skipped the session, and the White House has previously said autopen signatures are permissible under the Presidential Signature Act when the president authorizes their use. The Senate inquiry parallels a House Oversight Committee investigation in which Chairman James Comer subpoenaed former Biden White House physician Kevin O’Connor for a 27 June deposition. President Donald Trump, who succeeded Biden, has ordered a separate federal review, asserting that any unauthorized autopen signatures could nullify thousands of Biden-era measures. Biden has dismissed the allegations as politically motivated, saying he personally approved all decisions during his administration.
