Freight rail giant BNSF Railway has settled a landmark Illinois biometrics privacy case by agreeing to pay $75 million, down from an initial $228 million award, after a jury found the company in violation of privacy rights by unlawfully collecting fingerprint scans without consent from thousands of employees using automated gate systems at the company’s Illinois facilities. The case accused BNSF of breaching an Illinois state law that restricts the collection of biometric information such as fingerprints and eye scans.
